In response to the unprecedented increase in egg prices nationwide, the US Justice Department has initiated a preliminary investigation into potential collusion among major egg producers like Cal-Maine Foods Inc. and Rose Acre Farms Inc. The probe, conducted by the department's civil antitrust enforcers, aims to determine if these companies have deliberately inflated prices or restricted the supply of eggs, leading to skyrocketing costs for consumers.
As of February 28, a dozen large eggs in the Midwest were priced at an average wholesale cost of $8.41, marking a record high and a staggering 200% surge compared to the previous year, as reported by the US Department of Agriculture. This surge in egg prices, exacerbated by the worst-ever bird flu outbreak in the US that resulted in the loss of over 130 million birds since 2022, has sparked concerns among lawmakers, industry watchdogs, and the public.
While a spokesperson for the Justice Department declined to comment on the ongoing investigation, it is speculated that the probe may end without allegations of misconduct. Both Cal-Maine Foods and Rose Acre Farms, the leading egg producers in the nation, have yet to respond to requests for comment on the matter.
Initiated during the Trump administration, the investigation has now entered its initial stages under the Biden administration. The Department of Justice had previously scrutinized mergers within the egg market, and during Biden's term, efforts were made to strengthen the antitrust division's focus on agricultural markets with additional staff in Chicago.
Farm Action, an organization that has been advocating for a closer examination of egg prices for the past three years, welcomed news of the government’s actions. The group's president, Angela Huffman, suggested that the surge in egg prices may have deeper causes beyond the impact of the avian flu outbreak.
In response to concerns raised by Democratic Senator Jack Reed of Rhode Island, who criticized the Trump administration for inadequate response to the issue, USDA Secretary Brooke Rollins assured that efforts are being made to combat the rising egg prices and address the challenges posed by the avian flu outbreak.
The Capitol Forum was the first to report on the Justice Department's investigation into suspected egg price fixing, shedding light on a critical issue that has significant implications for consumers and the poultry industry.
