In a bold move, the Colombian Senate has pushed through a constitutional reform aimed at increasing government transfers to regional authorities, despite warnings of potential fiscal unsustainability. The reform, which passed in the sixth out of eight required debates, is now on its way to the lower house for two final votes, where the government's majority is expected to secure its approval.

Under the approved reform, the government is mandated to raise transfers to cities and provinces from 26% to 39.5% of its revenue over a 12-year period starting in 2027. This marks a deviation from the initial proposal of 46.5% over 10 years, as lawmakers sought to find a middle ground. Finance Minister Ricardo Bonilla's concerns about the fiscal feasibility of the reform were disregarded, with lawmakers opting for a higher transfer rate than he had suggested.

Bonilla had proposed a lower transfer threshold of 37% and a longer implementation timeline of 15-20 years, but his recommendations were not heeded, leading him to abstain from Tuesday’s debate. Additionally, the reform includes a provision for a separate bill that will delineate the distinct responsibilities of regional governments to avoid duplicating those of the central government.

Although the reform does not need the government's fiscal approval as it is a constitutional amendment, it will face scrutiny in the constitutional court after final ratification. As the legislative process moves forward, a sell-off in Colombian assets has intensified, causing concern among investors about the country’s already delicate fiscal situation. The potential implications of this reform on Colombia's financial stability loom large as the nation navigates the next phase of its economic development.
