Public health advocates have taken legal action against US regulators for the second time over their delay in implementing a much-needed ban on menthol-flavored tobacco products. Filed in a federal court in Northern California, the lawsuit alleges that the Food and Drug Administration (FDA) has unjustly postponed regulations that could ultimately save lives. Despite missing multiple deadlines, including the most recent one in March, the agency has yet to take definitive action on banning menthol in tobacco products.

Menthol cigarettes have long been a point of concern due to their appeal to new smokers and their detrimental health effects. Between 1980 and 2018, more than 10 million Americans initiated smoking habits through menthol cigarettes, leading to approximately 378,000 premature deaths, according to the Centers for Disease Control and Prevention (CDC). The marketing tactics employed by tobacco companies, particularly in Black communities, have disproportionately impacted African American smokers, with roughly 40% of excess deaths related to menthol cigarette use occurring within this demographic.

The cooling and throat-soothing properties of menthol play a significant role in amplifying nicotine addiction, making it a critical target for regulation. Sales of menthol cigarettes accounted for 37% of all cigarette sales in the US in 2021, underscoring the urgency for regulatory intervention. While flavored cigarettes other than menthol were banned in 2009, the FDA was tasked with evaluating the specific risks associated with menthol cigarettes, a process that has been protracted and subject to repeated delays.

In response to the FDA's inactivity, public health groups initiated legal proceedings in 2020, resulting in the agency's publication of draft proposals in April 2022 to eliminate the sale of menthol cigarettes and flavored cigars. However, subsequent delays have pushed back the final ruling to March 2024, prompting criticism from advocates who argue that the FDA has exhausted justifications for further procrastination. This lack of action not only perpetuates the health risks associated with menthol tobacco products but also reflects a broader pattern of sluggish responses to public health crises.

The potential financial impact of a menthol ban on industry players like Altria Group Inc., a prominent seller of Marlboro cigarettes, further complicates the regulatory landscape. While global restrictions on menthol have gained momentum, with bans already in place in the EU and Canada, the US lags behind in enacting comprehensive measures. Local bans in states like California and Massachusetts signal a growing recognition of the risks posed by menthol, underscoring the urgency for federal action to address this pressing public health issue.

As the legal battle unfolds in the case of African American Tobacco Control Leadership Council vs. US Department of Health and Human Services, the outcome will not only shape the future of tobacco regulation in the US but also have far-reaching implications for public health and equity. It remains to be seen whether the FDA will prioritize the well-being of its citizens by expeditiously implementing a ban on menthol-flavored tobacco products, potentially saving countless lives from the perils of nicotine addiction.
