The Competition and Markets Authority (CMA), the antitrust regulator in the UK, has announced that it is launching an investigation into the cloud infrastructure services market. The focus of the investigation is to determine if major players like Microsoft and Amazon have engaged in anti-competitive practices that make it difficult for UK customers to use multiple suppliers of essential cloud services.

Cloud computing firms, including Microsoft and Amazon Web Services (AWS), rely on data centers worldwide to offer remote access to computing services and storage. These cloud infrastructure services serve as the foundation for various software applications such as Gmail and Dropbox. The UK cloud infrastructure market has drawn scrutiny due to its high concentration and limited competition, as reported by Britain's media and communications regulator Ofcom.

CMA CEO Sarah Cardell expressed appreciation for Ofcom's referral, stating, "This is a £7.5 billion market that underpins a whole host of online services, making effective competition in this market essential." The investigation is expected to conclude by April 2025.

This probe is part of a broader wave of increased scrutiny faced by major tech companies from European regulators. In recent years, regulations regarding data protection and targeted advertising have been tightened. The European Digital Services Act, applicable to tech giants like Amazon, Apple, Google, Microsoft, Snapchat, TikTok, and Meta (owner of Facebook and Instagram), reflects one of the most comprehensive efforts by policymakers to regulate the tech industry.

Ofcom's report revealed that Microsoft and AWS collectively held a significant market share of 70-80% in the UK cloud infrastructure services market. Google emerged as their closest competitor, holding a share of 5-10%. The report also highlighted features of the market that hinder customers from easily switching providers or utilizing multiple providers, including switching fees.

According to Ofcom, the difficulty of switching providers and using multiple suppliers creates challenges for competitors looking to challenge dominant players like AWS and Microsoft. Additionally, concerns were raised about the software licensing practices, particularly regarding Microsoft.

Both Microsoft and Amazon indicated that they would engage "constructively" with the CMA. However, AWS disagreed with Ofcom's findings, stating that they believe the findings are based on a misunderstanding of how the IT sector functions. They also highlighted that cloud services have made provider switching easier than ever.

Microsoft, on the other hand, emphasized their commitment to maintaining an innovative and highly competitive UK cloud industry, serving as a catalyst for economic growth.

With the CMA investigation underway, the outcome will shed light on whether Microsoft, Amazon, and other major cloud service providers have engaged in anti-competitive practices in the UK market.
